This website is operated by Sticky Gecko ID. Throughout the site, the terms “we”, “us” and “our” refer to Sticky Gecko ID. Sticky Gecko ID offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

SECTION 1 - AUSTRALIAN CONSUMER LAW GUARANTEES

(a) Our products and services come with guarantees that cannot be excluded, restricted, or modified under the Australian Consumer Law (ACL), contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

(b) Nothing in these Terms of Service excludes, restricts, or modifies any guarantee, right, remedy, representation, or warranty implied or imposed by the ACL which cannot be lawfully excluded.

(c) If a product fails to meet a consumer guarantee (e.g., if the item is structurally defective or fundamentally unfit for purpose), you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

SECTION 2 - CUSTOMISATION AND ENGRAVING POLICY

Because our pet identification tags are permanently laser-engraved to your specific criteria, the following strict terms apply to all custom orders:

(a) Customer Input Accuracy: You are solely responsible for ensuring that all text, names, phone numbers, and formatting entered into the product customisation fields are accurate, complete, and spelled correctly. We will engrave your item exactly as it is submitted in your order data.

(b) Errors and Typos: We do not offer refunds, exchanges, or free replacements for products that contain spelling errors, typographical mistakes, incorrect contact details, or formatting errors made by the customer.

(c) Technical Character Limits: Text sizing and placement are dynamically optimised based on the layout parameters of our machinery. If you exceed the recommended character limits or field parameters on our storefront, we reserve the right to format the layout to ensure structural legibility without prior notice to you.

SECTION 3 - MATERIAL AND PRODUCTION DISCLAIMERS

(a) Manufacturing Variations: Our tags are manufactured using premium, industrial 304-grade stainless steel and processed with high-precision fiber laser technology. Minor surface variances, micro-polishing marks, or subtle variations in the dark contrast of the chemical-free annealing process are inherent characteristics of custom metal manufacturing and do not constitute a product defect.

(b) Display Accuracy: We make every effort to display the dimensions, finishes, and engraving appearances of our products as accurately as possible. However, because computer monitors and mobile displays render back-lit images differently, we cannot guarantee that the physical contrast or texture of the steel will perfectly match what you see on your screen.

SECTION 4 - ONLINE STORE TERMS & ORDER CONTROL

(a) We reserve the right to refuse service or cancel any order placed with us at any time for any reason.

(b) We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. This includes orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

(c) If we modify or cancel an order, we will attempt to notify you via the email, billing address, or phone number you provided at the time the order was made.

(d) You agree to provide current, complete, and accurate purchase and account information for all transactions made at our store.

SECTION 5 - PRICE AND SERVICE MODIFICATIONS

(a) Prices for our products are subject to change without notice.

(b) We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the storefront.

SECTION 6 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability.

Subject to our obligations under the Australian Consumer Law, we reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the site is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 7 - LIMITATION OF LIABILITY

(a) To the maximum extent permitted by law (but subject always to Section 1 of these Terms and your rights under the Australian Consumer Law), Sticky Gecko ID, our directors, officers, employees, or contractors will not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind.

(b) This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of our services or any products procured using the website.

SECTION 8 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Sticky Gecko ID and our partners, officers, directors, agents, contractors, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms of Service, your violation of any law, or your infringement of the rights of a third-party.

SECTION 9 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed to be severed from these Terms of Service, and such determination will not affect the validity and enforceability of any other remaining provisions.

SECTION 10 - GOVERNING LAW AND JURISDICTION

These Terms of Service, along with any separate agreements whereby we provide you products or services, are governed by, and must be construed in accordance with, the laws of the State of New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from those courts.
